On Ernst & Eyler, & On Judicial Retention Elections in Colorado

In Amerika, the Judicial Branch of Government is the most powerful Branch. There's an unholy alliance b/t the Police Branch & Judicial Branch where the Police Branch tail wags the Judicial Branch dog. The wimps in the Judicial Branch must suck-up to the muscled fascists they cower behind, & even though the Police Branch is supposed to be subordinate to the Executive Branch, the Legislative & Executive Branches don't check the Police Branch either.
For the 10th Judicial District, both Chief Judge Eyler & Allison Ernst are up for "retention elections". Trial Court terms are for 6 years. Deborah Eyler is still there, but Crockenburg is not. David W. Crockenberg retired December 2016, & then Governor Hickenlooper appointed Allison Ernst to replace Crockenberg. Ernst served 2017 in its entirety, & is currently finishing Crockenburg's term out.

Eyler became Chief Judge of the 10th Judicial District 6 years later, in the middle of 2012, before 75% of Pueblo joyfully voted her back into power that November. Deborah Eyler has been Chief Judging since 2012. For the last 6 years, Debbie has been the HBIC of Pueblo County's State Judicial Branch, the 10th Judicial District. Eyler has been convicting & jailing & fining the Puebloan people as Judge for the last 10 years. Perhaps the establishment could justify fighting to retain Debbie Eyler, but Allison Ernst?
Allison Ernst has been Judging Puebloans for less than 2 years. Allison Ernst is hardly establishment. Allison Ernst has only been Judging for a year & a half, but in a county with 14 Judges, what's the worst that could happen if we didn't retain either Eyler or Ernst, just out of principle of rejecting the retention election itself, for presenting a false option b/t "the same Judge as before" OR "nobody"? Plus, let's see what would happen. Let's conduct a science experiment. It's a rare day indeed whenever a Judge in Colorado isn't retained... what happens then? The Governor must appoint a different one? One we would all approve of this time? It would be worth not retaining either of these 2 Judges just to see how a failed Judicial retention election turns out. A Civics lesson for adults.
In 2012, David W. Crockenberg was retained with 76% of the Puebloan electorate voting in favor of him, & Deborah Eyler was retained with 75% of the electorate's approval. Virtually all State Judges in Colorado are retained by similar 75% margins (give or take 5%), in every district, for every level of State Judges & Courts - Supreme, Appeals, & Trial. In 2016, Larry Swartz won 71% in his retention election, giving him another 6 more years of power & money in the 10th Judicial Branch, on top of the 8 years he's already been employed here. In 2016, Thomas B. Flesher was also retained by 71% approval, after already being awarded substantial power & money for 8 years in Pueblo County. Flesher & Swartz still have 4 more years on their 6 year terms to fill.
David W. Crockenburg was retained in 2006 by 74%. Over 34,000 people in Pueblo County overwhelmingly endorsed him... Judge Cole won with 74% retention in the 10th Judicial District in 2006 also.
To an outsider, one would think Coloradoans absolutely adore their Judges... 71% retention rate... 74%... 75%... 76%... my god, "on a scale from 1 to 10, how much do Coloradoans love their Judges?", you'd have to give them a 7, or 8, if you round up. 7 out of 10 ain't bad. 8 out of 10 is incredible. Deborah Eyler doesn't even understand Constitutional Law, nor the Rule of Law, nor does she believe in victim's rights, nor giving folks their day in court, but on paper, of the 165,000 residents of Pueblo County, 3/4 of them adore her, worship her, & can't wait to reelect her again.
Debbie's perceived popularity is bullshit. It's a sham. A complete illusion. Most Puebloans - 65% - do not vote, so there's that. Few elections in Pueblo's entire history for decades have had "democratic legitimacy", since a "true blue democratic of, by, for-the-people kind of republic" requires majority support. But more importantly, most Puebloans don't know Deborah Eyler, & if they did, if they truly judged her on her own merits, I'm sure they wouldn't rubber-stamp her insider establishment ass back into power. Aren't all Americans guaranteed use of our own Public Courts? Don't all Coloradoans have rights as victims, codified in Colorado's Bill of Rights, Section 16a? Even if you never been unfairly treated or falsely accused in court, do you truly believe these Public Courts are yours?
Hey Americans: How often do you use your Public Courts to resolve your disputes? No wonder Street Justice appeals to so many more than Court Justice. At least as an outlaw, there's some sense of fairness. The American Court System is designed to be fair. It's a fake check on the police - a slaughterhouse - to throw people's lives away. The Executive & Legislative can spend money, but it's the Judicial Branch that destroys people, & their lives, forever, & not always b/c they're criminals. Sometimes it's b/c they're powerless & poor. Deborah Eyler only cares about what other Judges, Cops, & Lawyers think. Deborah Eyler, who makes 6 figures, & has had official State power for the past 10 years, doesn't give two shits about the homeless, poor, or working classes.
20% is considered a landslide in politics. If Candidate X received 40%, and Deborah Eyler had 60%, it would be said that Debbie landslided Candidate X. But Debbie won by 75%... 75% is greater than 60%, by 15 points. Debbie crushed her imaginary opponent to pieces. As a State Judge, Debbie will never have to worry about running against anybody else. Debbie may even feel like she's got a mandate to defend the system & the establishment which finances & empowers her against the public interest. Debbie may think she's got a mandate to run roughshod over everybody w/ her all encompassing invincible absolute power.
Retention elections are such bullshit, since the election for both Ernst & Eyler will be answering the question: "Keep Deborah Eyler for Judge, or ANARCHY!?!" Neither Ernst, nor Eyler, nor any Judge in Colorado for that matter, will have to compete against anybody. They're only running against themselves, & the public's perception of them, & the possible threat of ANARCHY breaking out in the city & countrysides, if their retention doesn't happen.
There's plenty of Judges in Pueblo County. Pueblo County has 14 Judges total, if you include the Magistrates. Pueblo County, in Pueblo City, houses 3 Magistrates (Radakovich, Styduhar, & Thomas), 7 10th Judicial "State" Judges (including Ernst & Eyler), 3 County Judges (Haynes, Lobato, & Fieldman, all up for election in 2019), and in the Municipal Courthouse, 1 Municipal Judge (Carla L. Sikes).
14 Judges is too many. Especially since none of them can Judge correctly that the City should have access to the County Jail. Nor that the City of Pueblo must comply w/ her own Charter, even if you don't want to. Pueblo can afford to lose a few Judges without it changing anything, except putting the Judicial Branch on notice, that now, after decades of a free ride, somebody's finally paying attention to them.

& we still have Larry Swartz & Larry B. Flesher around to Judge. Plus 3 County Judges (Haynes, Lobato, & Fieldman), 1 Municipal Judge (Sikes), & 3 other 10th Judicial Branch Judges - William Alexander, Kim Karn, & Jill S. Mattoon. We've got plenty of assholes who will happily volunteer, for 6 figures a year, to sit on a tall bench, towering over the tallest man, wearing a black robe, pretending to be better than any & errbody, & the world, judging people with or without Ernst & Eyler. Ernst & Eyler are not necessary for Pueblo County to function properly. In fact, they are probably the barrier to progress that needs to be removed.
